Agreement to Terms
By booking a tour or using the services of Discover Paradise Adventures Hawaiʻi ("Company," "we," "our," or "us"), you ("Guest," "you," or "your") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not book our tours or use our services.
Booking & Payment
Reservations
Tour reservations can be made through our website, by phone, or by email. A booking is confirmed only when you receive a confirmation email from us. We recommend booking at least 3-5 days in advance, especially during peak season.
Pricing
All prices are in US Dollars (USD) and are subject to change without notice until booking is confirmed. Prices listed on our website are per person unless otherwise stated. Group discounts and promotional rates are applied at time of booking.
Payment
Full payment is required at time of booking. We accept major credit cards and PayPal. Payment is processed securely through our third-party payment provider. By providing payment information, you represent that you are authorized to use the payment method.
Deposit & Balance
For private custom tours or large group bookings, we may require a deposit with the balance due 7 days before the tour date. We'll communicate specific payment terms at time of booking.
Cancellations & Refunds
Our detailed cancellation policy is available on our Cancellation & Safety Policy page. In summary:
- Cancellations 24+ hours before tour: Full refund
- Cancellations within 24 hours: 50% cancellation fee
- No-shows: No refund
- Weather/safety cancellations by us: Full refund or free rescheduling
Refunds are processed to the original payment method within 5-10 business days after cancellation.
Tour Participation Requirements
Physical Requirements
Guests must be in reasonable health appropriate for their chosen tour's difficulty level. You are responsible for accurately disclosing any medical conditions, physical limitations, or medications that may affect your ability to safely participate.
Age Requirements
Minimum age requirements vary by tour (typically 5+ years). Children under 18 must be accompanied by a parent or legal guardian. Age restrictions exist for safety reasons and will be enforced.
Required Documents
All guests must complete and sign a liability waiver before participating. Waivers are sent via email after booking. Parents/guardians must sign for minors.
Right to Refuse Service
We reserve the right to refuse service to any guest who:
- Appears under the influence of alcohol or drugs
- Exhibits unsafe, disruptive, or disrespectful behavior
- Does not meet physical or age requirements
- Arrives without required waivers or documentation
- Poses a safety risk to themselves or others
No refund will be issued if service is refused for these reasons.
Tour Changes & Substitutions
We reserve the right to modify tour itineraries, departure times, or substitute guides/vehicles as needed due to weather, road conditions, park closures, safety concerns, or other circumstances beyond our control.
If significant changes are necessary, we'll notify you as soon as possible and offer alternatives. If you're unsatisfied with the alternative, you may cancel for a full refund.
Guest Responsibilities
As a tour participant, you agree to:
- Arrive at pickup location on time (tours cannot be delayed for late arrivals)
- Follow all guide instructions and safety protocols
- Stay with your group and on designated trails
- Treat guides, staff, and other guests with respect
- Respect Hawaiian cultural sites and natural resources
- Practice Leave No Trace principles
- Wear appropriate clothing and footwear as specified
- Bring necessary personal items (medications, sunscreen, etc.)
- Inform guides immediately of any safety concerns or medical issues
Liability & Assumption of Risk
Adventure tourism involves inherent risks. By participating in our tours, you acknowledge and assume these risks, including but not limited to:
- Uneven terrain, slippery surfaces, and natural hazards
- Weather conditions (heat, rain, wind)
- Volcanic activity and associated risks
- Wildlife encounters
- Vehicle travel on mountainous roads
- Physical exertion and potential injury
Limitation of Liability
To the fullest extent permitted by law, Discover Paradise Adventures Hawaiʻi, its owners, employees, and guides shall not be liable for any injury, death, loss, damage, accident, delay, or expense arising from your participation in our tours, except in cases of gross negligence or willful misconduct.
We maintain liability insurance but are not responsible for losses due to weather, natural disasters, third-party actions, or circumstances beyond our reasonable control.
Personal Property
We are not responsible for lost, stolen, or damaged personal property. Please secure your valuables and consider travel insurance for expensive items.
Photography & Media
Our guides may take photos during tours for promotional purposes. By participating, you grant us permission to use photos/videos featuring you in our marketing materials, website, and social media without compensation.
If you prefer not to be photographed or have your image used, please inform your guide at the start of the tour.
Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of Discover Paradise Adventures Hawaiʻi or our licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission.
Complaints & Feedback
We strive to provide excellent experiences. If you have concerns during your tour, please inform your guide immediately so we can address them. For post-tour feedback or complaints, contact us within 7 days:

We'll investigate all complaints and respond promptly. Failure to notify us of issues during or shortly after your tour may limit our ability to provide remedies.
Force Majeure
We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, volcanic eruptions, pandemics, government restrictions, labor disputes, or other force majeure events.
Governing Law & Disputes
These Terms are governed by the laws of the State of Hawaiʻi, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Hawaiʻi County, Hawaiʻi.
For any disputes arising from these Terms or your tour participation, you agree to first attempt resolution through good-faith negotiation with our management.
Severability
If any provision of these Terms is found invalid or unenforceable, that provision shall be enforced to the maximum extent permitted, and the remaining provisions shall remain in full effect.
Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our services after changes constitutes acceptance of the new Terms.
